Terms of Service

DBloat is a general wellness and educational application that provides a facial fluid retention score, a personalised daily routine, and library content on wellness topics such as sleep, hydration, sodium, and lymphatic drainage. DBloat is intended for informational and educational purposes only.

DBloat is not a medical device. DBloat does not provide medical advice, medical diagnosis, or medical treatment. DBloat is not intended to diagnose or treat any medical condition. Always consult a qualified healthcare professional about any medical concern. Read the full Medical Disclaimer in the App before using the face scan feature.

You must be at least 13 years old to use DBloat. By using the App you represent and warrant that you are at least 13. If you are under 18, you additionally represent that a parent or legal guardian is aware that you use the App and consents to your use of it. If we discover that you are under 13 we will terminate your account.

You are responsible for maintaining the confidentiality of your account and for all activities under it. You agree to provide accurate information and to keep it up to date. You may not share your account.

DBloat offers auto-renewing subscriptions:

• Weekly plan and Yearly plan, prices as displayed in the App.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews at the same price for the same period unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage your subscription and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
• No cancellation of the current subscription is allowed during the active subscription period.
• Refunds, where offered, are handled by Apple in accordance with the Apple Media Services Terms and Conditions. We are unable to issue refunds directly.

If we offer a free trial or promotional price, the details, duration, and conditions will be presented in the App at the point of offer. Unless cancelled before the trial or promotional period ends, your subscription will convert to a full-price paid subscription automatically.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms.

You agree not to:

• Use the App for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with, disrupt, or attempt to gain unauthorised access to the App or its infrastructure
• Use the App to harm yourself or others
• Rely on the App for any medical decision
• Upload photographs of anyone other than yourself
• Use the App if you are pregnant, under 18, or have a medical condition that makes wellness self-tracking inappropriate for you without professional supervision

Face scan photographs and other content you submit remain yours. You grant us a limited licence to process that content solely to provide the App's features to you, as described in our Privacy Policy.

All rights, title, and interest in the App, including all text, graphics, code, branding, and library content, belong to Benjamin Milne (sole trader trading as DBloat) or our licensors. Nothing in these Terms transfers any intellectual property to you.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR THAT IT WILL PRODUCE ANY PARTICULAR RESULT. FACE SCAN SCORES ARE ESTIMATES ONLY AND MAY VARY WITH LIGHTING, ANGLE, EXPRESSION, AND NORMAL DAILY VARIATION.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Benjamin Milne (sole trader trading as DBloat) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) FIVE HUNDRED NORWEGIAN KRONER (NOK 500).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR GROSS NEGLIGENCE, (B) FRAUD OR FRAUDULENT MISREPRESENTATION, OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE NORWEGIAN LAW OR OTHER MANDATORY LAW APPLICABLE TO YOU AS A CONSUMER.

You agree to indemnify and hold harmless Benjamin Milne (sole trader trading as DBloat), its officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from your breach of these Terms or your misuse of the App.

We may suspend or terminate your access to the App at any time for breach of these Terms. You may stop using the App and delete your account at any time from Settings. Termination does not entitle you to a refund of any subscription fees except as required by law.

We may modify the App and these Terms from time to time. Material changes to the Terms will be surfaced in the App before they take effect. Your continued use of the App after changes take effect constitutes acceptance.

These Terms are governed by the laws of Norway, without regard to its conflict-of-law rules. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Norwegian courts, with Oslo District Court (Oslo tingrett) as the agreed legal venue. Nothing in this section limits your rights as a consumer under mandatory local law in your country of residence, including the right to bring proceedings in the courts of your home country where such a right is granted by applicable law. Consumers in Norway may also refer disputes to the Norwegian Consumer Authority (Forbrukertilsynet — forbrukertilsynet.no) or the Consumer Complaints Committee (Forbrukerklageutvalget).

You acknowledge that these Terms are between you and Benjamin Milne (sole trader trading as DBloat) only, and not with Apple Inc. Apple has no responsibility for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
